TERMS AND CONDITIONS FOR KLIKBCA BISNIS PT BANK CENTRAL ASIA Tbk (BCA)

A. Registration for KlikBCA Bisnis

  1. Any Customer that owns a business and has deposit account(s) with BCA may use the KlikBCA Bisnis facility.
  2. To enjoy the KlikBCA Bisnis facility, a Customer must have a user ID for KlikBCA Bisnis (Corporate ID and User ID), KeyBCA, and Personal Identification Number (PIN) to activate the KeyBCA and Virtual Private Network (VPN) Application, all of which are obtainable by the Customer upon registration for KlikBCA Bisnis.

B. KlikBCA Bisnis Facility/Service

  1. The KlikBCA Bisnis facility/service shall be provided according to the type of service package elected by the KlikBCA Bisnis Customer as set forth in the KlikBCA Bisnis Application Form.
  2. BCA may at anytime, on certain considerations, change the operation manual for KlikBCA Bisnis and will notify the KlikBCA Bisnis Customer of such change in any form and by any means in accordance with the laws in force.
  3. KlikBCA Bisnis Customer is prohibited from using KlikBCA Bisnis facility/service to perform actions that violate or conflict with the norms of decency, religion, morals, public order, law, or applicable laws and regulations.
  4. Without prior written approval from BCA, KlikBCA Bisnis Customer is prohibited from using KlikBCA Bisnis facility/service for the purpose of offering commercial services to other parties, among others services as fund transfer providers.

C. Other User ID Holders

  1. The KlikBCA Bisnis Customer may provide its nominee(s) with access to KlikBCA Bisnis on the full responsibility of the relevant KlikBCA Bisnis Customer.
  2. The KlikBCA Bisnis Customer which elects 'Single Authorization' shall grant access to KlikBCA Bisnis to the owner/holder of the User ID as set out in the KlikBCA Bisnis Application Form.
  3. The KlikBCA Bisnis Customer which elects 'Multi-Authorization' shall grant access to KlikBCA Bisnis to Sysadmin1 and Sysadmin2 as set out in the KlikBCA Bisnis Application Form to request the registration of other User IDs in the application provided to the KlikBCA Bisnis Customer.
  4. The level and limit on the transaction amount for each User ID owner/holder shall be determined by the KlikBCA Bisnis Customer or any person appointed by the KlikBCA Bisnis Customer.

D. Accounts, Credit Cards, and Merchant IDs

  1. Any account for transaction information (an account allowing the Customer to access information on the balance and/or history thereof through KlikBCA Bisnis) and any account for debit (a debitable account) must first be registered with BCA. All types of accounts opened at BCA can be registered for KlikBCA Bisnis.
  2. Any account with the status of 'guardian' or 'trustee' cannot be registered.
  3. Credit cards that can be registered on KlikBCA Bisnis by the KlikBCA Bisnis Customer are only those issued by BCA.
  4. The KlikBCA Bisnis Customer can register its merchant ID to KlikBCA Bisnis. Registration of the merchant ID allows the KlikBCA Bisnis Customer to download a report in the form as determined by BCA on transactions conducted on the EDC machine under the relevant merchant ID.
  5. Registration of any account including joint account, with ‘AND’ or ‘OR’ status, credit card, and merchant ID to KlikBCA Bisnis in a name different from the name of the KlikBCA Bisnis Customer must be accompanied by a power of attorney from the relevant account holder, credit cardholder, or merchant ID holder.
  6. The power of attorney shall contain the powers granted to the KlikBCA Bisnis Customer to access and conduct transactions using the account, credit card, and merchant ID specified in the power of attorney.
  7. The KlikBCA Bisnis Customer must be the same entity as the primary account holder registered on KlikBCA Bisnis by the KlikBCA Bisnis Customer. Joint account with ‘AND’ status must not be designated as the primary account
  8. BCA reserves the right to delete any account registered on KlikBCA Bisnis of the KlikBCA Bisnis Customer if for some reason the account is closed.
  9. If the KlikBCA Bisnis Customer closes its primary account or if, for some reason, its primary account is closed, the KlikBCA Bisnis Customer must designate a new primary account to replace the closed primary account. If the KlikBCA Bisnis Customer fails to designate a new primary account, the KlikBCA Bisnis Customer hereby agrees that BCA may designate any other account owned by the KlikBCA Bisnis Customer as the primary account.

E. Limit

  1. The daily limit on the transaction amount for each type of transaction is determined by the KlikBCA Bisnis Customer as set forth in the KlikBCA Bisnis Application Form subject to the terms and conditions applied by BCA. Notwithstanding the above provisions, the KlikBCA Bisnis Customer who obtains credit facility which has been registered on KlikBCA Bisnis, can pay the debt incurred from the credit facility through KlikBCA Bisnis in accordance with the daily limit determined by BCA which can be accessed on Transaction Limit Usage menu on KlikBCA Bisnis.
  2. In addition to the limit determined by the KlikBCA Bisnis Customer, there are certain transactions whose limit shall be determined according to the policy or procedure stipulated by Bank Indonesia, the Financial Services Authority (OJK), or any other competent authorities, or BCA. On certain considerations, BCA may change the daily limit on the transaction amountand/or transaction limit and shall notify the KlikBCA Bisnis Customer of the same in any form and by any means according to the prevailing law.

F. KeyBCA

  1. All holders of the User ID must have a KeyBCA.
  2. The KeyBCA remains the property of BCA and must be returned to BCA at the request of BCA.
  3. The KeyBCA may be used only by the KeyBCA holder and may not be transferred to other parties in any manner.
  4. The KeyBCA must not be used for purposes other than conducting the transactions determined by BCA.
  5. BCA will provide the KeyBCA holder with a Personal Identification Number (PIN) for the KeyBCA, and the PIN must be changed by the KeyBCA holder on receipt of the KeyBCA.
  6. All transactions conducted using the KeyBCA, whether with or without the knowledge of the KeyBCA holder, shall be the full responsibility of the relevant KeyBCA holder and the KlikBCA Bisnis Customer.
  7. If the KeyBCA is lost or stolen, the relevant User ID holder must report the loss or theft to BCA. For the replacement of the lost or stolen KeyBCA, the KlikBCA Bisnis Customer must complete a KlikBCA Bisnis Application Form and submit it to the BCA Branch Office as stipulated by BCA, accompanied by the supporting documents as may be required by BCA. To the extent a notice thereof is not received by BCA, all transactions conducted by using the lost or stolen KeyBCA shall be the full responsibility of the KlikBCA Bisnis Customer.
  8. If the KeyBCA is damaged, the relevant User ID holder must report the damage to BCA. Then, the KlikBCA Bisnis Customer must complete a KlikBCA Bisnis Application Form and submit it to the BCA Branch Office to which the KlikBCA Bisnis application was originally submitted or any other BCA Branch Office as stipulated by BCA, accompanied by the supporting documents as may be required by BCA. If the damage to the KeyBCA is irreparable, the KlikBCA Bisnis Customer may request a new KeyBCA.
  9. The application for a new or replacement KeyBCA due to damage, loss, or theft shall be subject to an administration fee at a rate as determined by BCA upon prior notification in any form and by any means.
  10. If the right of the User ID holder to access KlikBCA Bisnis is revoked, the relevant KeyBCA must be terminated. For such purpose, the KlikBCA Bisnis Customer must complete a KlikBCA Bisnis Application Form and submit it to the BCA Branch Office as stipulated by BCA, accompanied by the supporting documents as may be required by BCA.
  11. Any complaint and/or objection from the KeyBCA holder shall be dealt with only if such complaint and/or objection related to the use of the KeyBCA is lodged with BCA no later than 3 (three) months of the transaction date.
  12. BCA may at anytime block, cancel, revoke, or update the KeyBCA in any form if the KeyBCA holder is no longer compliant with the terms and conditions for the KeyBCA.
  13. If the KeyBCA and the KeyBCA PIN are not collected within 1 (one) month of the request, the KeyBCA shall be revoked and shall revert to BCA, but the administration fee shall remain applicable to and payable by the KlikBCA Bisnis Customer. BCA may delete the KlikBCA Bisnis facility (for a new application for KlikBCA Bisnis) and/or delete the KlikBCA Bisnis User ID (only for the KlikBCA Bisnis Customer electing "Single Authorization" in respect of the authorization type).
  14. Any use of the KeyBCA after the death of the relevant KeyBCA holder, if any, shall be the responsibility of the legitimate heir(s) of the KeyBCA holder and/or KlikBCA Bisnis Customer.
  15. The use of the KeyBCA is subject to the rules and regulations applicable at BCA and the terms and conditions for all facilities and transactions accessible by using the KeyBCA. BCA may at anytime alter the terms and conditions upon notice by BCA to the KlikBCA Bisnis Customer in any form and by any means according to the prevailing law.
  16. The KlikBCA Bisnis Customer must complete a KlikBCA Bisnis Application Form in the event of a change of the KeyBCA holder for the User ID not created by Sysadmin1 and Sysadmin2.

G. Virtual Private Network (VPN) Application

  1. The VPN application must be installed on the terminal owned by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer can also access KlikBCA Bisnis through a website to be notified by BCA.
  2. To access KlikBCA Bisnis, the KlikBCA Bisnis Customer must ensure that the VPN application is active.
  3. Any consequences arising from the misuse of the VPN application shall be the full responsibility of the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer hereby holds BCA harmless against any demand, claim, and/or any other legal action instituted by any other parties or the KlikBCA Bisnis Customer arising from the misuse of the VPN application.

H. Login/access to KlikBCA Bisnis

To access KlikBCA Bisnis, the KlikBCA Bisnis Customer must:

  1. Activate the VPN application.
  2. Enter the Corporate ID, User ID, and dynamic PIN generated by the KeyBCA (‘KeyBCA Response’).

I. Transactions on KlikBCA Bisnis

  1. The KlikBCA Bisnis Customer must correctly and completely provide all the data required for each transaction.
  2. For each financial transaction, the system will always seek confirmation of the data entered by the KlikBCA Bisnis Customer, and the KlikBCA Bisnis Customer shall have the opportunity to cancel the transaction by pressing the "Back" button.
  3. As evidence of its approval, the KlikBCA Bisnis Customer shall be required to input the KeyBCA Response to authorize any financial transaction.
  4. Any information with the "Submit" confirmation from the KlikBCA Bisnis Customer as stored in BCA’s data center shall be deemed as accurate data and accepted as proof of instruction from the KlikBCA Bisnis Customer to BCA for the relevant transaction, except as proven otherwise by the KlikBCA Bisnis Customer.
  5. BCA shall accept and process any instruction from the KlikBCA Bisnis Customer as a valid instruction based on the correct input of the Corporate ID, User ID, and KeyBCA Response, and therefore, BCA is under no obligation to check or investigate the authenticity or validity or authority of the user of such Corporate ID, User ID, and KeyBCA Response or judge or prove the accuracy or completeness of such instruction, and therefore, the instruction shall be deemed to be conclusive and binding on the KlikBCA Bisnis Customer, except as proven otherwise by the KlikBCA Bisnis Customer.
  6. For any transaction with an effective date of the same day (immediate), the KlikBCA Bisnis Customer cannot cancel any transaction duly authorized by the KlikBCA Bisnis Customer using the KeyBCA once the "Submit" confirmation is received from the KlikBCA Bisnis Customer because BCA will immediately process the instruction on a real time basis.
  7. For any transaction to be effective at a later date (post date) or for any periodic transaction (recurring), the KlikBCA Bisnis Customer can cancel the transaction by authorizing the cancellation with the KeyBCA no later than 1 (one) business day prior to the effective date/due date of the relevant transaction.
  8. For any periodic transaction (recurring), the transaction will be processed at the start of the day. If the expiry date falls on the same day as the determined periodic effective date, the relevant transaction will not be processed.
  9. Any transfer of funds denominated in a different currency shall be subject to the exchange rate applicable at BCA.
  10. For each transaction successfully processed by BCA based on the instruction from the KlikBCA Bisnis Customer, the KlikBCA Bisnis Customer shall receive a proof of transaction in the form of a reference number as evidence that the transaction has been processed by BCA.
  11. BCA reserves the right not to execute any instruction from the KlikBCA Bisnis Customer, among others if the balance in the account of the KlikBCA Bisnis Customer at BCA is insufficient, the KlikBCA Bisnis Customer’s account is blocked or closed, or if there is any indication of impropriety on instructions of the KlikBCA Bisnis Customer.
  12. The KlikBCA Bisnis Customer must ensure the completeness and accuracy of the transaction instruction. BCA shall not be liable for any consequences arising from incomplete and obscure data or inaccurate instruction from the KlikBCA Bisnis Customer.
  13. BCA shall not be liable for any losses arising from the use of the KlikBCA Bisnis application and any KlikBCA Bisnis device that is contrary to the directions contained in the operation manual for KlikBCA Bisnis provided by BCA and any losses arising from the fault or negligence of KlikBCA Bisnis Customer in conducting the transaction.
  14. The KlikBCA Bisnis Customer must maintain the security of the KlikBCA Bisnis device, the User ID of KlikBCA Bisnis, and the KeyBCA PIN used with the KlikBCA Bisnis application to prevent any unauthorized reproduction or misuse of the KlikBCA Bisnis device, User ID of KlikBCA Bisnis, and the KeyBCA PIN in any form.
  15. The KlikBCA Bisnis Customer acknowledges that BCA is the owner of the copyrights and other intellectual property rights on KlikBCA Bisnis application and the KlikBCA Bisnis device.
  16. The KlikBCA Bisnis Customer shall not interfere with, change, alter, or misuse in any manner all KlikBCA Bisnis applications and KlikBCA Bisnis devices.
  17. The KlikBCA Bisnis Customer fully agrees to hold BCA harmless against all costs, damage, losses, liabilities, or any expenses, whether directly or indirectly arising from a breach by the KlikBCA Bisnis Customer of its obligations in respect of the KlikBCA Bisnis application or any other consequences arising from and/or relating to the use of the KlikBCA Bisnis application.
  18. The KlikBCA Bisnis Customer must not duplicate, assign, or transfer all or any rights, benefits, or obligations related to the use of KlikBCA Bisnis to any other parties without the written consent of BCA.

J. Customer Portfolio Report

  1. Customer Portfolio Report is a monthly and/or annual report containing a summary and details of product portfolio owned by the KlikBCA Bisnis Customer at BCA.
  2. The Customer Portfolio Report provides an overview of the total value of each KlikBCA Bisnis Customer Portfolio at BCA the report of which is requested by KlikBCA Bisnis Customer and may consist of a portfolio of fund products, credit card products, credit products, and investment products such as mutual funds, bonds, and/or bancassurance, according to the request of the KlikBCA Bisnis Customer. For fund products, account data included in the Customer Portfolio Report includes the following:
    1. data of the KlikBCA Bisnis Customer’s accounts, both registered and unregistered with KlikBCA Bisnis of the KlikBCA Bisnis Customer; and
    2. single and/or joint account owned by the KlikBCA Bisnis Customer.
  3. The Customer Portfolio Report can be accessed by all owners/holders of User ID registered by the KlikBCA Bisnis Customer or party appointed by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer shall be fully liable for the access of the Customer Portfolio Report by the owner/holder of the User ID and hereby holds BCA harmless from all demands, claims, and/or any other legal actions from any parties.

K. Business Dashboard

  1. Business Dashboard is a menu provided on KlikBCA Bisnis to facilitate the KlikBCA Bisnis Customer to monitor payment and payment receipt transactions related to the KlikBCA Bisnis Corporate ID belonging to the KlikBCA Bisnis Customer (“Transactions”) in real time.
  2. By accessing the Business Dashboard, the KlikBCA Bisnis Customer can obtain information related to the Transactions, including:
    1. status details and daily transaction data;
    2. transaction reports.
  3. Status details, daily transaction data, and/or transaction reports provided on the Business Dashboard (“Data”) are generated from Transaction data.
  4. The Data provided on the Business Dashboard cannot be used as a reference to reflect or determine the cause of:
    1. system and device constraints used in Transactions processing that can be atributed to BCA, the KlikBCA Bisnis Customer, or other parties whose services are used by BCA or the KlikBCA Bisnis Customer;
    2. the difference between the Transaction data on the Business Dashboard and the data owned by the KlikBCA Bisnis Customer; or
    3. other conditions that may affect the processing of Transactions.
  5. In the event of any difference between the Transaction data on the Business Dashboard and the data owned by the KlikBCA Bisnis Customer, the data which prevails is the Transaction data available on the Business Dashboard, unless proven otherwise by the KlikBCA Bisnis Customer.
  6. The KlikBCA Bisnis Customer is fully responsible for the use of the Data and holds BCA harmless against any demand, claim, and/or other legal actions of any kind and from any party in connection with the use of the Data by the KlikBCA Bisnis Customer including misuse of the Data.
  7. The KlikBCA Bisnis Customer which elects “Multi Authorization” may determine User ID owner/holder which is authorized to access the Business Dashboard while for User ID owner/holder who have been granted the right to access KlikBCA Bisnis by the KlikBCA Bisnis Customer which elects “Single Authorization” can directly access the Business Dashboard without requiring further appointment from the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer is fully responsible for the access of the Business Dashboard by the User ID owner/holder and hereby holds BCA harmless against any demand, claim, and/or other legal actions from any party.

L. Payroll/Auto-Collection/Auto-Credit/Multi Auto-Collection/Multi Auto-Transfer/Multi Payroll Data Upload

  1. For a Payroll/Auto-Collection/Auto-Credit/Multi Auto-Collection/Multi Auto-Transfer/Multi Payroll transaction, the KlikBCA Bisnis Customer must use the Checksum Generator program to produce the check sum file to secure the transmission of data files to BCA’s data center. Checksum Generator Program can be downloaded by the KlikBCA Bisnis Customer in KlikBCA Bisnis. In order to upload transaction file, the KlikBCA Bisnis Customer is required to upload check sum file produced by the Checksum Generator. The file cannot be uploaded if there is a mismatch between the transaction file data and the check sum file.
  2. The Payroll files must be uploaded no later than 2 (two) business days prior to the effective date of the transaction as intended by the KlikBCA Bisnis Customer.
  3. The KlikBCA Bisnis Customer hereby declares that the Payroll/Auto-Collection/Auto-Credit/Multi Auto-Collection/Multi Auto-Transfer/Multi Payroll data have been truthfully made and carefully reviewed, and therefore, any errors made, including but not limited to, a discrepancy in the name and account number or amount of money stated in the uploaded file shall be the full responsibility of the KlikBCA Bisnis Customer.
  4. Especially for Multi Auto-Collection/Multi Auto-Transfer/Multi Payroll transactions, the File Upload menu only shows that the transaction file has been received by BCA for further processing. To check whether the transaction file upload is successful or not, the KlikBCA Bisnis Customer shall check the Transaction Status menu. After the transaction file has been successfully uploaded, the KlikBCA Bisnis Customer must authorize the successfully uploaded transaction file on the Transaction Authorization menu.

M. Auto-Collection Transaction

  1. In the event the KlikBCA Bisnis Customer intends to debit the account of the debit account holder, the KlikBCA Bisnis Customer must first obtain a power from the debit account holder. The power can be obtained based on a power of attorney of the debit account holder which is signed by each debit account holder or by virtue of the power granted by the debit account holder through BCA banking facilities or other means that will be notified by BCA in any form and by any means.
  2. The Power of Attorney from the debit account holder means the power of attorney granted by the debit account holder to the KlikBCA Bisnis Customer to debit its account.
  3. In the event the authority to debit an account is granted by the debit account holder through the power of attorney, the KlikBCA Bisnis Customer must collect the originals of the power of attorney and the following supporting documents:
    1. a copy of the identity card of the debit account holder that has been verified against the original, and
    2. the proof of account ownership of the debit account holder in the form of a copy of front page of a pass book, a copy of the Paspor BCA card which includes the name of the debit account holder, a copy of bank statement/printed e-statement, or a combination of 2 (two) documents below:
      • a copy of the Paspor BCA card (without the name of the customer);
      • QR Code displayed from the m-BCA facility on BCA mobile which includes the debit account holder’s account number and name;
      • other account statement in the form other than bank statement/printed e-statement;
      • e-mail containing information on the account opening of the debit account holder (for debit account holder who opens an account online through BCA’s banking facility or facility of any other party having cooperation with BCA (if any));
  4. The KlikBCA Bisnis Customer must send all originals of the power of attorney and supporting documents as referred to in point 3 above to BCA completely no later than 7 (seven) business days before the debiting from the debit account is conducted.
  5. The powers granted by the debit account holder to the KlikBCA Bisnis Customer may be revoked only with the prior written approval of the KlikBCA Bisnis Customer and such revocation shall be effective if the notice thereof has been received by the authorized officer at BCA and the process has been completed by BCA no later than 7 (seven) business days after BCA receives the notice of the revocation of the power of attorney approved by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer must:
    1. check and guarantee the authenticity and accuracy of the power of attorney, including the authenticity and accuracy of the signature of the debit account holder as affixed to the power of attorney, which has been or will be submitted by the KlikBCA Bisnis Customer to BCA.
    2. b. check the veracity and authenticity of the supporting documents received by the KlikBCA Bisnis Customer and guarantee that the copies of the supporting documents, which have been or will be submitted by the KlikBCA Bisnis Customer to BCA, have been verified against the originals.
  6. In relation to the power of attorney from the debit account holder, BCA has no obligation to check:
    1. the veracity and authenticity of the signature of the debit account holder making and signing the power of attorney and the supporting documents submitted by the KlikBCA Bisnis Customer to BCA.
    2. the veracity and authenticity of the signature of the competent officer of the KlikBCA Bisnis Customer.
  7. In relation to the power granted by the debit account holder through BCA banking facilities or other means determined by BCA, the KlikBCA Bisnis Customer shall provide data for the power debit registration of the debit account (such as customer number) and the KlikBCA Bisnis Customer shall be fully liable for the accuracy of the data for the power debit registration of the debit account. BCA has no obligation to check the accuracy of the data for the power debit registration of the debit account received by BCA from the KlikBCA Bisnis Customer.
  8. All consequences arising in connection with:
    1. the debiting of an account belonging to a debit account holder; and
    2. the accuracy and authenticity of the signature of the competent officer of the KlikBCA Bisnis Customer, authority of the officials of the KlikBCA Bisnis Customer granting a written approval/confirmation regarding the revocation of the power of attorney, the signature’s authenticity of the debit account holder making and signing the power of attorney and the supporting documents, misuse of power of attorney and supporting documents as referred to in these Terms and Conditions for KlikBCA Bisnis;

    shall be the full responsibility of the KlikBCA Bisnis Customer and the KlikBCA Bisnis Customer hereby undertakes to bear all losses suffered by BCA and holds BCA harmless from all demands and/or claims from any parties in connection with this matter.

  9. On certain considerations, BCA may refuse to process the power of attorney it receives if, among others, there is a discrepancy in the name of the debit account holder between the one specified in the power of attorney and the one stated in the supporting documents or BCA’s data or the supporting documents received by BCA are not complete.
  10. In the event of an objection, demand, claim, and/or other legal action of any kind from any parties, including from the debit account holder for the grant of a power of attorney to the KlikBCA Bisnis Customer or the debit of the account of the debit account holder by the KlikBCA Bisnis Customer; therefore, the KlikBCA Bisnis Customer must prove the accuracy of the power of attorney document as well as the debit account data (such as the customer number and billing amount). If the KlikBCA Bisnis Customer cannot prove it, the KlikBCA Bisnis Customer shall return all funds belonging to the debit account holder that has been debited by the KlikBCA Bisnis Customer from the account of debit account holder and compensates for all losses suffered by BCA in connection with this matter.
  11. KlikBCA Bisnis Customer shall ensure and hereby guarantees that the debiting of the debit account holder will be conducted constantly according to the agreement between the KlikBCA Bisnis Customer and the debit account holder, among others relating to the debiting amount and account debiting frequency.
  12. The KlikBCA Bisnis Customer shall be fully liable for any consequences, including any losses suffered by BCA, arising from the Auto-Collection transaction processed by BCA based on the instruction of the KlikBCA Bisnis Customer.
  13. In connection with points 8, 10, 11, and 12 above, the KlikBCA Bisnis Customer hereby authorizes BCA to debit the account of the KlikBCA Bisnis Customer in the amount debited from the debit account holder’s account to be credited to the concerned debit account holder’s account and the amount of losses suffered by BCA. These powers will continue to be valid and shall not terminate or be revoked for any reason whatsoever, including those specified in Articles 1813, 1814, and 1816 of the Indonesian Civil Code so long as the KlikBCA Bisnis Customer still has outstanding obligations to the debit account holder and/or BCA under these Terms and Conditions for KlikBCA Bisnis.

N. Other Bank Multi Auto-Collection Transaction

  1. In the event the KlikBCA Bisnis Customer intends to carry out a billing transaction to an account at another bank (collectible bank) by using the Multi Auto-Collection menu (Multi Auto-Collection transaction), the KlikBCA Bisnis Customer shall provide the data required for the Multi Auto-Collection transaction such as customer reference numbers of the KlikBCA Bisnis Customer and the KlikBCA Bisnis Customer shall ensure the veracity, completeness, and accuracy of the Multi Auto-Collection transaction data before uploading such data.
  2. The KlikBCA Bisnis Customer shall upload and release transaction files on the Transaction Authorization menu in accordance with the applicable terms of BCA as may be notified by BCA to KlikBCA Bisnis Customer in any form and by any means in accordance with the prevailing law. The success status on the Transaction Authorization menu only indicates that the transaction file has been successfully sent by BCA to the collectible bank. The transaction file can be accepted or rejected by the collectible bank in accordance with the results of processing carried out by the collectible bank.
  3. The KlikBCA Bisnis Customer is aware that BCA only forwards instructions from the KlikBCA Bisnis Customer to the collectible bank based on the Multi Auto-Collection transaction file uploaded by the KlikBCA Bisnis Customer. BCA has no obligation to examine or investigate the veracity and accuracy of the Multi Auto-Collection transaction data uploaded by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer shall be liable for all consequences and losses arising from the fault in or inaccuracy of the Multi Auto-Collection transaction data, including if it turns out that the Multi Auto-Collection transaction nominal is not in accordance with the agreement between the KlikBCA Bisnis Customer and the customer of KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer hereby holds BCA harmless from all demands, claims, and/or any other legal actions from any parties, including from the KlikBCA Bisnis Customer in connection with this matter.
  4. BCA will only process Multi Auto-Collection transaction on business days. If the effective date of the Multi Auto-Collection transaction falls on a holiday, the transaction will be rejected and will not be processed by BCA.
  5. In the event that the collectible bank is late in providing information on the refusal to BCA at a time determined by BCA, such as due to system disturbances, BCA has the right to make corrections to the funds that have been credited by BCA to the account of the KlikBCA Bisnis Customer. In this connection, the KlikBCA Bisnis Customer hereby authorizes BCA to debit the account of the KlikBCA Bisnis Customer. Such power will continue to be valid and shall not terminate or be revoked for any reason whatsoever, including those specified in Articles 1813, 1814 and 1816 of the Indonesian Civil Code so long as the KlikBCA Bisnis Customer still has outstanding obligations to BCA.
  6. The KlikBCA Bisnis Customer shall be liable for all consequences arising from the correction failure which results in debt that must be immediately paid by the KlikBCA Bisnis Customer to BCA and/or for losses suffered by BCA in connection with the execution of the Multi Auto-Collection transaction to an account at another bank based on the instructions of the KlikBCA Bisnis Customer.
  7. The KlikBCA Bisnis Customer will be charged fees for the successful and unsuccessful process of Multi Auto-Collection transactions, the amount of which will be notified by BCA in any form and by any means in accordance with the prevailing law.

O. Multi Auto-Transfer Transaction

  1. The KlikBCA Bisnis Customer shall upload and release transaction files on the Transaction Authorization menu in accordance with the applicable terms of BCA as may be notified by BCA to KlikBCA Bisnis Customer in any form and by any means in accordance with prevailing law.
  2. Particularly for funds transfers to domestic banks, the success status on the Transaction Authorization menu only indicates that the transaction file has been successfully sent by BCA to the destination bank. The transaction file may be accepted or rejected by the destination bank according to the results of the processing carried out by the destination bank.
  3. The KlikBCA Bisnis Customer is aware that BCA only forward instructions from the KlikBCA Bisnis Customer to the destination bank based on the Multi Auto-Transfer transaction file uploaded by the KlikBCA Bisnis Customer. BCA has no obligation to examine or investigate the correctness and accuracy of the Multi Auto-Transfer transaction data uploaded by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer shall be liable for all consequences and losses arising from the incorrect or inaccurate data of the Multi Auto-Transfer transaction. The KlikBCA Bisnis Customer hereby holds BCA harmless from all demands, claims, and/or any other legal actions from any parties including from the KlikBCA Bisnis Customer in connection with this matter.
  4. Particularly for funds transfers to domestic banks, BCA will only process the Multi Auto-Transfer transaction on business days. If the effective date of the Multi Auto-Transfer transaction falls on a holiday, the transaction will be rejected and will not be processed by BCA.
  5. BCA has the right to charge fees for both successful and unsuccessful Multi Auto-Transfer transactions, the amount of which will be notified by BCA in any form and by any means in accordance with the prevailing law.
  6. The KlikBCA Bisnis Customer can determine the types of fees charged for Multi Auto-Transfer transactions, namely:
    1. OUR, is the imposition of fees for Multi Auto-Transfer transactions to the KlikBCA Bisnis Customer as the sender;
    2. BEN, is the imposition of fees for Multi Auto-Transfer transactions to the recipient of funds by deducting the transfer value that will be received by the recipient;
    3. SHA, is the imposition of fees for Multi Auto-Transfer transaction to sender and recipient;
  7. In the event the KlikBCA Bisnis Customer perfoms a Multi Auto-Transfer transaction to a BCA Virtual Account, the KlikBCA Bisnis Customer is fully aware that the KlikBCA Bisnis Customer can be charged a fee for the Multi Auto-Transfer transaction to the BCA Virtual Account by the recipient, with the applicable type of fees charged is OUR.
  8. Fees incurred for unsuccessful Multi Auto-Transfer transactions will still be charged to KlikBCA Bisnis Customer.
  9. BCA shall not be liable for the failure of the Multi Auto-Transfer transaction to the BCA Virtual Account which is caused by, among others, the difference between the amount charged to the KlikBCA Bisnis Customer and the amount of the Multi Auto-Transfer transaction to the BCA Virtual Account that is inputted by the KlikBCA Bisnis Customer.
  10. BCA shall not be liable for the insufficient transfer amount that should have been received by the recipient as a result of the imposition of a Multi Auto-Transfer transaction fee determined by the KlikBCA Bisnis Customer.

P. Multi Payroll Transaction

  1. The KlikBCA Bisnis Customer may determine the time and date of Multi Payroll transaction processing, in accordance with the time and date of transaction processing applicable at BCA. BCA may refuse to carry out Multi Payroll transactions beyond the time and date of transaction processing applicable at BCA.
  2. The KlikBCA Bisnis Customer hereby undertakes to authorize the Multi Payroll transactions no later than 1 (one) calendar day before the Multi Payroll transaction is carried out. In the event the authorization of the Multi Payroll transaction is authorized by the KlikBCA Bisnis Customer on the day the Multi Payroll transaction then BCA may charge additional fees to the KlikBCA Bisnis Customer. This fee will be debited from the source account of the Multi Payroll transaction.
  3. Multi Payroll transactions will be carried out in accordance with the following:
    1. in accordance with the time of Multi Payroll transaction processing if the Multi Payroll transaction is authorized before the time of Multi Payroll transaction processing;
    2. at the time the Multi Payroll transaction is authorized if the authorization is made after the time of Multi Payroll transaction processing as determined by the KlikBCA Bisnis Customer as long as such authorization is conducted on the same date as the date of transaction processing as determined by the KlikBCA Bisnis Customer;
      subject always to the time of Multi Payroll transactions processing applicable at BCA.
  4. The KlikBCA Bisnis Customer may cancel a Multi Payroll transaction that has been authorized, no later than 1 (one) calendar day before the date of Multi Payroll transaction processing.
  5. Multi Payroll transactions may be directed to accounts at BCA or to accounts at other domestic banks by following the applicable regulations. The Facility of Multi Payroll transaction to accounts at other domestic bank is available for use only after the KlikBCA Bisnis Customer has received prior written approval from BCA.
  6. Multi Payroll transactions directed to an account at other domestic banks will be processed on business days. If the time of the Multi Payroll transaction processing directed to an account at other domestic bank falls on a public holiday, such Multi Payroll transaction will be rejected and will not be processed by BCA.
  7. Multi Payroll transactions to accounts at BCA or to accounts at other domestic banks will be carried out based on the account number entered by the KlikBCA Bisnis Customer. If there is a difference between the account number and the name of the recipient of the funds provided by the KlikBCA Bisnis Customer with the name of the recipient at the destination bank, the payment to the recipient may be made by the destination bank based on the account number of the recipient of the funds or otherwise in accordance with the policy of the destination bank.
  8. For Multi Payroll transactions directed to an account at other domestic banks, the success status on the Transaction Authorization menu only indicates that the Multi Payroll transaction file has been successfully sent by BCA to the destination bank. The Multi Payroll transaction file may be accepted or rejected by the destination bank according to the result of the process carried out by the destination bank.
  9. The KlikBCA Bisnis Customer is aware that BCA only forwards instructions from the KlikBCA Bisnis Customer to the destination bank based on the Multi Payroll transaction file uploaded by the KlikBCA Bisnis Customer. BCA has no obligation to verify or investigate the correctness and accuracy of the Multi Payroll transaction data uploaded by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer is fully responsible for all consequences and losses arising from the incorrect or inaccurate Multi Payroll transaction data. The KlikBCA Bisnis Customer hereby holds BCA harmless from all demands, claims, and/or any other legal actions from any parties, including from the clients of the KlikBCA Bisnis Customer with regard to such matter.
  10. Multi Payroll transactions to accounts at other domestic banks will be charged according to the selected Multi Payroll transaction type.
  11. In the event the KlikBCA Bisnis Customer wishes to send proof of the Multi Payroll transaction to the e-mail address of the recipient of funds of the Multi Payroll transaction, the KlikBCA Bisnis Customer is required to fill in the e-mail address of the recipient of funds of the Multi Payroll transaction in the Multi Payroll transaction file uploaded by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer must ensure that the email address of the recipient of funds of the Multi Payroll transaction is truly owned by the relevant recipient of fund. The KlikBCA Bisnis Customer is fully responsible for all consequences arising from the sending of the Multi Payroll transaction proof to the e-mail address of the recipient of funds of Multi Payroll transaction provided by the KlikBCA Bisnis Customer.
  12. BCA may charge fees for successful and unsuccessful Multi Payroll transactions, the amount of which will be notified by BCA in any form and by any means in accordance with the applicable terms.
  13. The KlikBCA Bisnis Customer must ensure that upon the debiting of the account of the KlikBCA Bisnis Customer, the funds in the account of the KlikBCA Bisnis Customer is sufficient for the Multi Payroll transactions and for the fees charged to the KlikBCA Bisnis Customer with regard to the Multi Payroll transaction.

Q. Interbank Transfer

  1. 1. BCA provides interbank funds transfer services to domestic and overseas banks with the following conditions:
    1. funds transfer in Indonesian Rupiah currency can be made through LLG (Giral Traffic), RTGS (Real Time Gross Settlement), online services, and BI-FAST.
    2. funds transfer in foreign currency can be made through Outward Remittance services.
  2. In the event the KlikBCA Bisnis Customer conducts funds transfer through online services and BI-FAST, then BCA will display the name of the destination account owner for the money transfer in accordance with the data received by BCA from the destination bank. The name of the destination account owner for the money transfer that is displayed may differ from the full name of the name of the destination account owner for the money transfer recorded at the destination bank. BCA is not responsible for the rejection of money transfer transactions caused by such difference in the name referred to.
  3. Funds transfer through LLG (Giral Traffic), RTGS (Real Time Gross Settlement) and Outward Remittance services will be carried out with the following conditions:
    1. If the effective date of money transfer transaction falls on working days, then the transaction will be processed on the same business day;
    2. If the effective date of money transfer transaction falls on a holiday, then the transaction will be processed on the next business day.
  4. Funds transfer through online services and BI-FAST will be processed on the same day in real time.
  5. As regards any interbank funds transfer to a domestic or overseas bank, if the effective date of the transaction falls on a bank holiday, the transaction will be processed on the following banking day. BCA shall not be liable for any consequences arising from the loss of/delay in the transmission of information or messages related to the interbank funds transfer to a domestic or overseas bank resulting from any disruption, damage, error, or any other causes beyond the control of BCA.
  6. No interbank funds transfer whether to a domestic or overseas bank can be made through KlikBCA Bisnis if the transaction is set to recurring.
  7. The KlikBCA Bisnis Customer hereby grants power to BCA to elect a correspondent bank or paying bank to execute the interbank funds transfer instruction from the KlikBCA Bisnis Customer, and therefore, the KlikBCA Bisnis Customer holds BCA harmless against any liability for the loss arising from the non-execution of the funds transfer instruction by the correspondent bank or paying bank elected by BCA based on the power granted by the KlikBCA Bisnis Customer.
  8. The paying bank shall be responsible for paying the funds into the beneficiary’s account or to the beneficiary upon receipt of the funds in immediately transferable form by the paying bank.
  9. If the correspondent bank/paying bank deducts a certain fee from the amount transferred, such fee shall be for the account of the beneficiary.
  10. The KlikBCA Bisnis Customer shall be bound by all obligations and responsibilities under the prevailing law in Indonesia and any provisions applicable at the correspondent bank/paying bank. If BCA incurs any fee charged by the correspondent bank/paying bank, the KlikBCA Bisnis Customer shall reimburse BCA for all amounts charged to BCA relating to the funds transfer from the relevant KlikBCA Bisnis Customer.
  11. In the event of any discrepancy in the account number and beneficiary’s name between those set forth in the interbank funds transfer field on KlikBCA Bisnis and those with the paying bank, then the paying bank may make such payment to the beneficiary by solely relying on the beneficiary's account number or otherwise at the paying bank's sole discretion.
  12. BCA and/or the correspondent bank shall not be liable for any losses of any kind arising from the regulations or policies issued by the government in the relevant country or for any other reasons beyond the control of BCA or the correspondent bank.
  13. All consequences arising from the prevailing laws and regulations or customs in the country where the correspondent bank or the paying bank is located shall be the full responsibility of the KlikBCA Bisnis Customer, and the KlikBCA Bisnis
  14. Customer hereby holds BCA harmless against all demands and/or claims from any parties and undertakes to indemnify BCA against such demands and/or claims.
  15. The KlikBCA Bisnis Customer hereby grants approval to BCA to provide the correspondent bank/paying bank with the data it has input on the KlikBCA Bisnis application to enable it to transfer the funds of the KlikBCA Bisnis Customer.

R. Distributor Financing Invoice Upload

  1. The KlikBCA Bisnis Customer can upload invoice to KlikBCA Bisnis for the purposes of billing payments to business partners of the KlikBCA Bisnis Customer who have received a loan facility from BCA based on the Distributor Financing cooperation scheme, on every calendar day. If the KlikBCA Bisnis Customer upload invoice on a holiday, then BCA will process the invoice on the first business day after the holiday.
  2. The KlikBCA Bisnis Customer is fully responsible on the validity of data uploaded to KlikBCA Bisnis, such as Principal code, distributor code, invoice number, invoice amount, loan realization date, and other data uploaded by the KlikBCA Bisnis Customer.
  3. BCA has the right to not process the loan realization on invoice uploaded by the KlikBCA Bisnis Customer if:
    1. The loan realization date is earlier than the uploaded data processing date;
    2. The loan ceiling of the business partner of the KlikBCA Bisnis Customer is insufficient of blocked;
    3. The format of the data uploaded by the KlikBCA Bisnis Customer is not in accordance with the format determined by BCA; or
    4. The data uploaded by the KlikBCA Bisnis Customer is incomplete.
  4. All disputes arising between the KlikBCA Bisnis Customer and business partners of the KlikBCA Bisnis Customer in connection with the Distributor Financing cooperation scheme between BCA and the KlikBCA Bisnis Customer become the full responsibility of the KlikBCA Bisnis Customer and will be resolved by the KlikBCA Bisnis Customer and the business partner of the KlikBCA Bisnis Customer without involving BCA.
  5. Terms regarding the cooperation in providing loan facilities to business partner of the KlikBCA Bisnis Customer based on the Distributor Financing cooperation scheme will be further regulated in a separate agreement between BCA and the KlikBCA Bisnis Customer and business partners of the KlikBCA Bisnis Customer.

S. Credit Facility

  1. The KlikBCA Bisnis Customer can:
    1. conduct balance credit information, account statement, and documents inquiry;
    2. download credit documents;
      related to credit facility received by the KlikBCA Bisnis Customer from BCA, by accessing the menu provided by BCA at KlikBCA Bisnis. The types of credit information, account statement, and documents that can be inquired and credit documents that can be downloaded will be notified by BCA to the KlikBCA Bisnis Customer in any form and by any means.
  2. Inquiry of credit information and account statement related to credit facility as referred to in point 1 above can be done at the latest 2 (two) business days after BCA’s approval to provide credit facility to the KlikBCA Bisnis Customer.
  3. BCA provides billing payment services for certain credit facilities (“ Outstanding Debts”) through KlikBCA Bisnis.
  4. The Outstanding Debts that can be paid through KlikBCA Bisnis is a credit facility in the name of the KlikBCA Bisnis Customer.
  5. BCA is entitled to determine the terms and procedures to pay the Outstanding Debts that will be informed by BCA to the KlikBCA Bisnis Customer in any form and by any means in accordance with the applicable terms.
  6. The Outstanding Debts payment can only be made using the funds from the KlikBCA Bisnis Customer’s account registered as operational account on KlikBCA Bisnis.
  7. The Outstanding Debts payment through KlikBCA Bisnis cannot be done for postdated transaction.
  8. The KlikBCA Bisnis Customer can make Outstanding Debts payment instructions on every calendar day subject to the time limit determined by BCA.
  9. The KlikBCA Bisnis Customer may authorize the Outstanding Debts payment transaction instruction on a different day from the date when the Outstanding Debts payment instruction was made, at the latest 30 (thirty) calendar days since the Outstanding Debts payment transaction instruction is made. The amount of Outstanding Debts displayed on the KlikBCA Bisnis screen when the Outstanding Debts payment transaction instruction is authorized may be different from the amount of Outstanding Debts at the time the Outstanding Debts payment transaction instruction is made in accordance with the calculation of interest or late fees incurred (if any) on the date the Outstanding Debts payment transaction instruction is authorized.
  10. The Outstanding Debts displayed on the screen of the KlikBCA Bisnis Customer are inclusive of principal amount, interest in arrears (if any), and late fees (if any).
  11. Specially for Outstanding Debts payment through KlikBCA Bisnis, any conditions regarding transaction limit does not apply, therefore, the KlikBCA Bisnis Customer may make payment based on the amount of the Outstanding Debts displayed on KlikBCA Bisnis screen.

T. Invoice Management

  1. The KlikBCA Bisnis Customer can use Invoice Management menu at KlikBCA Bisnis for the purposes of:
    1. inquiring invoice that has been uploaded by the principal who has entered into Supply Chain Finance cooperation with BCA, the administration of which is conducted through certain facilities in accordance with the applicable terms of BCA (“Supply Chain Finance”);
    2. payment of the Supply Chain Finance invoice as referred to in point 1.a above. Payment can only be made using the funds in the account owned by the KlikBCA Bisnis Customer;
    3. request for financing to BCA for invoice payments and/or factoring related to Supply Chain Finance as referred to in point 1.a above.
  2. Invoice Management Menu can only be accessed:
    1. by the KlikBCA Bisnis Customer who has entered into Supply Chain Finance cooperation as referred to in point 1.a above;
    2. through specified means in accordance with the applicable terms at BCA which will be notified by BCA to the KlikBCA Bisnis Customer in any form and through any means in accordance with the applicable terms.
  3. All disputes arising between the KlikBCA Bisnis Customer and the principal in connection with the Supply Chain Finance above shall become the full responsibility of the KlikBCA Bisnis Customer and will be resolved by the KlikBCA Bisnis Customer and the principal without involving BCA.

U. Tax Payment

  1. The KlikBCA Bisnis Customer can pay taxes through the special menu provided by BCA on KlikBCA Bisnis.
  2. Tax payment through KlikBCA Bisnis for the time being can be made only in rupiah denomination and the amount to be paid cannot be in a decimal value.
  3. The tax payment transaction shall be processed only after the KlikBCA Bisnis Customer authorizes such tax payment transaction through KlikBCA Bisnis.
  4. The authorization for the tax payment transaction through KlikBCA Bisnis must be done by the KlikBCA Bisnis Customer in accordance with the provisions applicable at BCA.
  5. The KlikBCA Bisnis Customer must ensure that when its account is debited, the balance standing to the credit of its account is sufficient for the tax payment transaction.
  6. BCA, on certain considerations, may refuse to process the tax payment transaction conducted by the KlikBCA Bisnis Customer, among others, if the data inputted and uploaded by the KlikBCA Bisnis Customer is incomplete or inconsistent with the format determined by BCA, or if the maximum daily limit on the amount or frequency of tax payment transactions has been exceeded, or if the balance to the credit of the account of the KlikBCA Bisnis Customer is insufficient.
  7. A tax payment transaction shall be deemed successful if the account of the KlikBCA Bisnis Customer is successfully debited and the State Revenue Transaction Number (NTPN) and the Bank Transaction Number (NTB) are successfully issued.
  8. The KlikBCA Bisnis Customer declares that the data related to the tax payment have been correctly made and carefully checked, and therefore, any errors in the tax payment data, including but not limited to any discrepancy in the name and account number or any errors in the amount of funds stated in the file uploaded or inputted through KlikBCA Bisnis shall be the full responsibility of the KlikBCA Bisnis Customer.
  9. The KlikBCA Bisnis Customer shall be fully liable for all consequences arising from each transaction or activity conducted by the KlikBCA Bisnis Customer related to the tax payment transaction through KlikBCA Bisnis, including but not limited to errors in data registration, data input or upload by the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer hereby holds BCA harmless against all demands, claims, and/or any other legal actions from any parties, including the KlikBCA Bisnis Customer.
  10. The KlikBCA Bisnis Customer may download any tax payment report with the status "successful", made by the KlikBCA Bisnis Customer within the period determined by BCA as may be notified by BCA in any form and by any means in accordance with the prevailing law.

V. Exchange Rate

All information on exchange rates, interest rates, and any other rates, including but not limited to the stock quotes provided on KlikBCA Bisnis only shows indications of the actual exchange rates, quotes, or information and is subject to change at anytime by BCA without prior notice to the KlikBCA Bisnis Customer.

W. Host to Host ERP Integration

  1. The KlikBCA Bisnis Customer may use Host to Host ERP Integration facility on KlikBCA Bisnis to send data which includes both transaction data and other data as well as documents from the Enterprise Resource Planning (ERP) system of the KlikBCA Bisnis Costumer to BCA system by using Corporate ID to carrying out transactions in accordance with the features available on KlikBCA Bisnis and/or other transactions that can be accessed by using Corporate ID. The data and/or documents received by BCA system from the ERP system of the KlikBCA Bisnis Customer shall be processed with or without authorization process through KlikBCA Bisnis according to the option chosen by the KlikBCA Bisnis Customer.
  2. The types of transaction that can be made by the KlikBCA Bisnis Customer through Host to Host ERP Integration facility on KlikBCA Bisnis are in accordance with the types of transaction selected by the KlikBCA Bisnis Customer on the KlikBCA Bisnis Application Form.
  3. Every transaction instruction received by BCA from the ERP system of the KlikBCA Bisnis Customer is a valid and correct instruction from the KlikBCA Bisnis Customer and binds and becomes the full responsibility of the KlikBCA Bisnis Customer. BCA has no obligation to examine or investigate the veracity of the transaction instruction received by BCA from the ERP system of the KlikBCA Bisnis Customer.
  4. The KlikBCA Bisnis Customer fully guarantees the veracity of the documents received by BCA from the ERP system of the KlikBCA Bisnis Customer. BCA has no obligation to examine or investigate the veracity or the authenticity of the documents received by BCA from the ERP system of the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer is fully responsible for all consequences and losses arising in connection with the use of documents sent by the KlikBCA Bisnis Customer from the ERP system of the KlikBCA Bisnis Customer.
  5. In conducting transactions through the Host to Host ERP Integration facility on KlikBCA Bisnis, the KlikBCA Bisnis Customer is required to observe the terms and conditions applicable at BCA, among others, those which are related to the time limit for sending transaction data and the maximum limit of data that can be processed. BCA has the right to change the terms and conditions related to the transactions which will be notified to the KlikBCA Bisnis Customer in any form and by any means.
  6. BCA has the right not to process transaction instruction through the Host to Host ERP Integration facility on KlikBCA Bisnis, among others if:
    1. the transaction instruction provided by the KlikBCA Bisnis Customer does not comply with transactions terms and conditions applicable at BCA which will be notified by BCA to the KlikBCA Bisnis Customer;
    2. the transaction instruction received by BCA after the lapse of time limit for sending transaction data and/or exceeds the limit of maximum data that can be processed.
  7. The KlikBCA Bisnis Customer must ensure the availability of funds in the accounts which serve as the source account of transactions.
  8. The KlikBCA Bisnis Customer cannot cancel any transaction instruction with the effective date of the same day (immediate):
    1. which has been received by BCA without being authorized by the KlikBCA Bisnis Customer on KlikBCA Bisnis (non-workflow); or
    2. which has been authorized by the KlikBCA Bisnis Customer on KlikBCA Bisnis using KeyBCA (workflow).
  9. In order to use the facility of Host to Host ERP Integration on KlikBCA Bisnis:
    1. The KlikBCA Bisnis Customer is required to provide adequate facilities in accordance with the terms determined by BCA;
    2. BCA will provide:
      1. BCA Client application, which includes:
        1. i. User ID and BCA Client Monitoring password;
        2. ii. Security Key Pretty Good Privacy (PGP);
      2. SFTP BCA application, which includes:
        1. i. SFTP User ID and SFTP User ID password;
        2. ii. Pretty Good Privacy (PGP) Security Key;
          (“Devices”).
  10. Any misuse of, disruption or damage to the Devices that occurs after the handover of the Devices and installation of the BCAClient application and the SFTP BCA application as evidenced by a handover certification executed by BCA and the KlikBCA Bisnis Customer will become the full responsibility of the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer hereby holds BCA harmless against demand, claim, and/or any other legal action from any party including from the KlikBCA Bisnis Customer in connection with this matter.
  11. In order that the Devices that have been handed over by BCA to the KlikBCA Bisnis Customer are able to function optimally and remain in safe condition, the KlikBCA Bisnis Customer is required to maintain the security of the Devices. All losses arising from the failure to maintain the security and to carry out maintenance of the Devices will become the full responsibility of the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer has the obligation to provide and guarantee the availability of access needed by BCA or any party appointed by BCA for the maintenance of the Devices.
  12. The KlikBCA Bisnis Customer is prohibited from:
    1. using the Devices other than for the purpose of carrying out transactions through the Host to Host ERP Integration facility on KlikBCA Bisnis;
    2. making changes to settings, configurations, and any changes to the Devices provided by BCA;
    3. doing business or attempting to break codes, to hack, to crack, to do software, shareware, freeware virus penetration or creating fake/imitation applications that aim to interfere or damage the Devices;
    4. reproducing, imitating, copying, pirating, falsifying the Devices provided by BCA including but not limited to source code, manuals, operating systems, program languages, codes, schemes or other forms.
  13. In the event of misuse of, disruption or damage to the ERP system of the KlikBCA Bisnis Customer, all consequences and losses arising in connection with this matter shall be the full responsibility of the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer hereby holds BCA harmless from and against any demand, claim, and/or other legal actions from any party including from the KlikBCA Bisnis Customer in connection with this matter.
  14. For the use of the Host to Host ERP Integration facility on KlikBCA Bisnis, BCA has the right to charge fees to the KlikBCA Bisnis Customer, the amount of which is in accordance with the terms and conditions applicable at BCA and the payment of which shall be made by debiting the account of the KlikBCA Bisnis Customer at BCA.
  15. The KlikBCA Bisnis Customer is required to take all necessary actions to ensure that every transaction made through the Host to Host ERP Integration facility on KlikBCA Bisnis can only be carried out by the parties who are authorized to carry out the transaction. All losses arising from misuse of transactions through the Host to Host ERP Integration facility are the responsibility of the KlikBCA Bisnis Customer.

X. Evidence

  1. The KlikBCA Bisnis Customer agrees that all records, tapes/cartridges, computer print-outs, copies, or any other forms of information or data storage shall constitute valid evidence of an instruction from the KlikBCA Bisnis Customer, and so shall any other means of communication received or sent by BCA.
  2. The KlikBCA Bisnis Customer acknowledges the validity, veracity, or authenticity of the evidence of any instruction and communication electronically transmitted between the two parties, including any documents in the form of computer records or BCA proofs of transactions, tapes/cartridges, computer printouts, copies, or any other forms of information storage, and all of such devices or documents constitute valid evidence of the banking transactions conducted through KlikBCA Bisnis, except as proven otherwise by the KlikBCA Bisnis Customer.
  3. By conducting a transaction through KlikBCA Bisnis, the KlikBCA Bisnis Customer acknowledges that all communications and instructions received by BCA from the KlikBCA Bisnis Customer shall be treated as valid evidence although not in written form or in a signed document.

Y. Corporate ID, User ID, KeyBCA, and KeyBCA PIN

  1. The Corporate ID provided by BCA is permanent and cannot be changed.
  2. BCA may provide a Corporate ID in the form of a combination of letters and numbers without the prior approval of the KlikBCA Bisnis Customer.
  3. The KlikBCA Bisnis Customer and any other User ID holders designated by the KlikBCA Bisnis Customer must not leave the terminal while logged on; in other words, it must first log out before leaving the terminal.
  4. The KlikBCA Bisnis Customer and any other User ID holders designated by the KlikBCA Bisnis Customer must secure its User ID, KeyBCA, and KeyBCA PIN by:
    1. not disclosing its User ID, KeyBCA PIN, and KeyBCA Response to any other parties.
    2. not writing down its User ID, KeyBCA PIN, and KeyBCA Response on a desk, the terminal, or storing them in writing or in a computer application or any other storage means allowing others to see them.
    3. carefully using its User ID, KeyBCA PIN, and KeyBCA Response to prevent others from seeing them.
    4. not using the KeyBCA PIN made or provided by another party or easily guessed by others, such as a birth date or any combination thereof, and a phone number.
  5. Any consequences of the misuse of the Corporate ID, User ID, and KeyBCA shall be the full responsibility of the KlikBCA Bisnis Customer. The KlikBCA Bisnis Customer hereby holds BCA harmless against all demands arising from other parties or the KlikBCA Bisnis Customer due to the misuse of the Corporate ID, User ID, and KeyBCA.
  6. The User ID is permanent. If the KlikBCA Bisnis Customer wishes to change its User ID, the KlikBCA Bisnis Customer must request that its old User ID, including the KeyBCA connected to such User ID be deleted and subsequently request a new User ID and KeyBCA. For this purpose, the KlikBCA Bisnis Customer that does not have any Sysadmin must complete the KlikBCA Bisnis Application Form and submit it to the BCA Branch Office in accordance with the applicable provisions at BCA, accompanied by the supporting documents as determined by BCA.
  7. The KlikBCA Bisnis Customer shall be fully liable for all transaction instructions given by using the Corporate ID, User ID, and KeyBCA Response, except as proven otherwise by the KlikBCA Bisnis Customer.
  8. The KlikBCA Bisnis Customer must immediately notify BCA if its User ID, KeyBCA PIN, and KeyBCA Response are known by other parties. All transaction instructions given by using the User ID, Key BCA PIN, and KeyBCA Response before the competent officer of BCA receives the notice in writing shall be the full responsibility of the KlikBCA Bisnis Customer.
  9. The use of the KeyBCA and the KeyBCA Response shall have the same legal force as a written instruction signed by the KeyBCA holder.

Z. Electronic Mail (Email)

  1. The KlikBCA Bisnis Customer must register its active and valid email address.
  2. In the event of a change of the email address, the KlikBCA Bisnis Customer must immediately effect the change by completing the KlikBCA Bisnis Application Form and submit it to the BCA Branch Office in accordance with the applicable provisions at BCA, accompanied by the supporting documents as may be required by BCA.
  3. The email address will be used by BCA to send information on a financial transaction conducted by the KlikBCA Bisnis Customer and information on a non-financial transaction conducted by the Sysadmin through KlikBCA Bisnis and to send any other information.
  4. If the KlikBCA Bisnis Customer fails to receive a notification email on the day the transaction is processed, the KlikBCA Bisnis Customer must check the transaction status through the 'Transaction Status' facility in KlikBCA Bisnis application. If the KlikBCA Bisnis Customer fails to receive the notification email and/or check its transaction status, the KlikBCA Bisnis Customer shall hold BCA harmless against any claims for losses that may arise therefrom.
  5. The KlikBCA Bisnis Customer is also provided with an 'email' facility on KlikBCA Bisnis, which can be used to communicate with BCA.
  6. BCA gives no guarantee of the security of the information or data sent to BCA through an 'Email' not provided on KlikBCA Bisnis or in the format not approved or designated by BCA.
  7. BCA shall not be liable for non-delivery of information to the KlikBCA Bisnis Customer's email address occurring not as a result of BCA’s fault or negligence.
  8. BCA has no obligation to save and resend any non-delivered information to the KlikBCA Bisnis Customer's email address.
  9. BCA shall not be responsible for the correctness, accuracy, or the completeness of the beneficiary's email address, including any incorrectness of the beneficiary’s email address. BCA shall not be responsible for any transmission failure or misdirected transmission of transaction information to the beneficiary’s email address occurred not as a result of BCA’s fault or negligence. BCA is not obliged to save and resend the transaction information failed to be transmitted to the beneficiary's email address. Any consequences arising from the use of this facility become the sender’s and/or KlikBCA Bisnis Customer's sole liability.

AA. Fees and Authority to Debit Account

  1. BCA may debit the monthly administration fee (if applicable), the fee for interbank funds transfer, and/or the fees for other transactions through KlikBCA Bisnis at the rates as determined and notified by BCA.
  2. In the event of BCA’s failure in processing the transaction on the intended effective date but not due to BCA’s fault, the KlikBCA Bisnis Customer shall remain liable to the applicable fee.
  3. The KlikBCA Bisnis Customer hereby authorizes BCA to debit its account(s) at BCA for the relevant transactions instructed by the KlikBCA Bisnis Customer to BCA through KlikBCA Bisnis and for the payment of the fees as specified in point 1 above in respect of the KlikBCA Bisnis facility.
  4. These powers shall not terminate for any reasons whatsoever, including those specified in Articles 1813, 1814, and 1816 of the Indonesian Civil Code so long as the KlikBCA Bisnis Customer still has outstanding obligations to BCA.

BB. Blockage of Corporate ID, User ID, KeyBCA, and KeyBCA PIN

  1. The KeyBCA shall be blocked if:
    • The KeyBCA PIN is incorrectly entered 3 (three) times in a row.
    • it is reported damaged or lost.
  2. The User ID shall be blocked if the KeyBCA Response is incorrectly entered 3 (three) times in a row when a transaction is conducted by using the KeyBCA.
  3. The Corporate ID shall be blocked if the KlikBCA Bisnis Customer terminates the KlikBCA Bisnis facility.
  4. In the event of such blockage, the KlikBCA Bisnis Customer must contact BCA and follow the instructions and procedure given by BCA.

CC. Administration of registration, change, and deletion

  1. Every time the KlikBCA Bisnis Customer wishes to register, change, or delete any data and/or status of the Corporate ID, User ID, and KeyBCA, the KlikBCA Bisnis Customer must complete the KlikBCA Bisnis Application Form.
  2. BCA will verify and check the completeness of the data provided in the KlikBCA Bisnis Application Form and supporting documents submitted by the KlikBCA Bisnis Customer. BCA may reject and return the KlikBCA Bisnis Application Form if BCA finds any inconsistency or lack of data and supporting documents.
  3. BCA will effect the registration, change, or deletion upon verification and review of the KlikBCA Bisnis Application Form and supporting documents.

DD. Force Majeure

  1. The KlikBCA Bisnis Customer hereby holds BCA harmless against all demands, claims, and/or any legal actions if BCA fails to execute any instructions, whether partially or wholly, due to events or causes beyond the control of BCA, including but not limited to, natural disasters, war, riot, equipment, system or transmission breakdown, power failure, telecommunication failure, government policy, and any other events or causes beyond the control of BCA.
  2. BCA shall not be liable for any loss in the event of any disruption to the KlikBCA Bisnis application and KlikBCA Bisnis device due to the fault of the KlikBCA Bisnis Customer or other causes such as virus, power failure, disconnected cable, damage to computer hardware.

EE. Temporary Suspension and Termination of Facility

  1. The KlikBCA Bisnis facility will terminate if the KlikBCA Bisnis Customer terminates the use of the KlikBCA Bisnis facility by completing the KlikBCA Bisnis Application Form and submit it to BCA Branch Office in accordance with the provisions applicable at BCA, accompanied by the KeyBCA and the supporting documents as may be required by BCA.
  2. On certain considerations, BCA has the right to temporarily suspend or terminate the KlikBCA Bisnis facility, among others, the license of the KlikBCA Bisnis Customer is terminated or revoked or the use of such KlikBCA Bisnis facility is in violation of the Terms and Conditions for KlikBCA Bisnis and the prevailing law.
  3. BCA may terminate the KlikBCA Bisnis facility if all accounts of the KlikBCA Bisnis Customer linked to the KlikBCA Bisnis facility are closed at the customer's request or for any other reasons or if the KlikBCA Bisnis Customer deletes all registered User IDs.

FF. Amendment to the Terms and Conditions for KlikBCA Bisnis

BCA may at anytime amend, supplement, or modify the Terms and Conditions for KlikBCA Bisnis and BCA shall notify the KlikBCA Bisnis Customer of the same in any form and by any means according to the prevailing law.

GG. Language

These Terms and Conditions for KlikBCA Bisnis are made and signed in two (2) versions of languages, namely Indonesian and English. In the event that there is a discrepancy in interpretation between the versions of Indonesian and English, then the version of Indonesian language shall prevail.

HH. Disputes Resolution

  1. The KlikBCA Bisnis Customer agrees that any disputes or disagreements arising from and/or relating to the implementation of these Terms and Conditions for KlikBCA Bisnis between the KlikBCA Bisnis Customer and BCA will be resolved by deliberation.
  2. Any disputes or disagreements that cannot be resolved by deliberation by the KlikBCA Bisnis Customer and BCA, will be resolved through banking facilitation (fasilitasi perbankan) at Bank Indonesia or the Financial Services Authority or mediation through Alternative Dispute Resolution Agencies listed in the List of Alternative Dispute Resolution Agencies issued by the Financial Services Authority.
  3. Any disputes or disagreements that cannot be resolved by deliberation, banking facilitation, and/or mediation as referred to in point 2 above, will be resolved through Central Jakarta District Court, without prejudice to BCA’s right to file claims or demands through other District Courts within the territory of the Republic Indonesia.

The KlikBCA Bisnis Customer hereby confirms that it has read, understood, and accepted the contents of these Terms and Conditions for KlikBCA Bisnis and that BCA has given explanation and asked for confirmation to the KlikBCA Bisnis Customer of the explanation about benefits, fees, and risks related to KlikBCA Bisnis.

THESE TERMS AND CONDITIONS FOR KLIKBCA BISNIS HAVE BEEN ADJUSTED IN COMPLIANCE WITH THE PREVAILING LAWS AND REGULATIONS INCLUDING REGULATIONS OF THE FINANCIAL SERVICES AUTHORITY
