Paylater BCA Terms & Conditions


A. DEFINITIONS

  1. BCA means PT Bank Central Asia Tbk.
  2. BCA ID means an identification code created by the customer consisting of numbers, letters, or a combination of both, used to access a BCA ID e-Channel.
  3. BCA ID e-Channel means a BCA electronic channel that can be accessed by using the BCA ID to conduct banking transactions and/or obtain information related to services or products marketed through BCA, which will be notified by BCA from time to time in any form and through any means.
  4. Merchant means a trader of goods and/or services that can accept payments using Paylater BCA.
  5. myBCA means a facility for making banking transactions on the customer's account at BCA and for obtaining information on the products and/or services provided by BCA and other parties cooperating with BCA through a browser and/or a mobile app that can be downloaded from the official application/software distribution media designated by BCA, which is owned by the mobile operating system of the customer's mobile device.
  6. Cellular Operator means a company that provides cellular network services.
  7. BCA ID Password means personal password that must be created and entered by the BCA ID user to be able to access e-channel BCA ID.
  8. Paylater BCA means a credit facility based on information technology, which is provided by BCA through myBCA and/or other channels in accordance with the provisions applicable at BCA. Paylater BCA is subject to certain limits and can be used to pay for transactions.
  9. Paylater BCA User means a BCA customer who receives the Paylater BCA facility by BCA.
  10. PIN (Personal Identification Number) means a 6-digit personal identification number for use by the customer to make a financial transaction via the mobile version of myBCA.
  11. Quick Response Code or QR Code means a two-dimensional code consisting of three square pattern markers in the lower left corner, upper left corner, and upper right corner, with black modules in the form of dots or pixels in a square pattern, which can store alphanumeric data, characters, and symbols.
  12. QR Code for Payment or Payment QR Code means a QR Codethat is used for contactless payment transactions by means of scanning.
  13. National Standard for Payment QR Code (Quick Response Code Indonesian Standard) orQRIS means a standard Payment QR Code as stipulated by Bank Indonesia for facilitating payment transactions in Indonesia.
  14. Transaction means a payment transaction at the Merchant by using Paylater BCA.

B. TERMS OF USE

  1. BCA has the right to approve or reject any application for Paylater BCA made by the Customer to BCA.
  2. If the Paylater BCA application is approved by BCA, BCA will provide the Paylater BCA User with the Paylater BCA facility.
  3. The Paylater BCA User can only have 1 (one) Paylater BCA account connected to 1 (one) BCA ID at the same time.
  4. The Paylater BCA User is prohibited from transferring Paylater BCA to another party, and Paylater BCA can only be used for the sole benefit of the Paylater BCA User.
  5. BCA shall not be responsible for any payment with Paylater BCA that is rejected by the Merchant.
  6. BCA will pay in advance to the Merchant and/or the bank/non-bank institution for all Transactions made by the Paylater BCA User using Paylater BCA based on the billing data received by BCA. The Paylater BCA User shall be responsible for paying the transaction amount set out in the billing data to BCA.
  7. If BCA receives the billing data in a currency other than the rupiah, the amount will be converted by BCA into the rupiah based on the exchange rate determined by BCA on the date such billing data are received.
  8. BCA will provide the Paylater BCA User with a monthly billing statement listing all the Transactions made by the Paylater BCA User in the form of soft copy (e-Statement) by sending it to the Paylater BCA User’s email registered by the Paylater BCA User with BCA when applying for Paylater BCA. The Billing Statement can also be accessed by the Paylater BCA User via the Paylater BCA dashboard menu on myBCA.
  9. The Paylater BCA User must immediately notify BCA of any change of data such as the Paylater BCA User's email address, and mobile phone number. Any consequences arising from a delay in receiving or failure to receive the Billing Statement due to the Paylater BCA User's failure to notify such change of the Paylater BCA User's data shall be the full responsibility of the Paylater BCA User. The Paylater BCA User's delay in receiving or failure to receive the Billing Statement shall not release the Paylater BCA User from its obligation to pay all the amounts due arising from the use of Paylater BCA, including late charges and interest, according to the provisions applicable at BCA.
  10. The Paylater BCA User must make full payment of the billing amount as specified in the Billing Statement by the due date of the relevant billing month.
  11. BCA will debit the account designated by the Paylater BCA User every month (autodebit) with the total billing amount arising from the use of Paylater BCA as specified in the Billing Statement (including any interest and late charge) on the due date. The autodebit will only be processed as long as there is sufficient balance in the Paylater BCA User's account to cover the total billing amount arising from the use of Paylater BCA and the account is not blocked.
  12. The Paylater BCA User may also pay the total billing amount arising from the use of Paylater BCA as specified in the Billing Statement in accordance with the payment terms determined by BCA before the due date. If payment is made by cheque/bilyet giro, it will be deemed received when it has been actually received by BCA in good funds. If the cheque/bilyet giro is dishonored or canceled, the Paylater BCA User will be charged an administration fee and/or other fees (if applicable) in the amount as determined and notified by BCA in any form and through any means in accordance with the applicable law.
  13. If the Paylater BCA User fails to pay the billing amount or the amount paid differs from the amount specified in the Billing Statement, the Paylater BCA User will be subject to a late payment penalty in accordance with the applicable provisions, and this will affect the Paylater BCA User’s collectability.
  14. A delay by the Paylater BCA User in making the full payment of the billing amount arising from the use of Paylater BCA (including any interest and late charge) may cause a Transaction to be rejected. BCA has the right to block Paylater BCA if on the due date BCA does not receive the payment of the total billing amount arising from the use of Paylater BCA.
  15. If the Paylater BCA User's credit quality is classified as ‘bad debt’ (macet), BCA may use the services of another party for debt collection until all of the Paylater BCA User's obligations to BCA are fully settled.
  16. If, in addition to Paylater BCA, the Paylater BCA User also obtains other credit facilities from BCA, the Paylater BCA User’s collectability with respect to the use of Paylater BCA and such other credit facilities from BCA will follow the lowest credit collectability assigned according to the data of the Paylater BCA User’s credit facilities on record with BCA.
  17. The Paylater BCA User shall bear all the charges and fees incurred in connection with the provision and use of Paylater BCA including but not limited to interest, late charges, stamp duty and any other fees that will be notified by BCA to the Paylater BCA User in any form and through any means in accordance with the applicable law.
  18. If the SIM Card issued by the Cellular Operator and/or the Paylater BCA User’s cellular phone is lost/stolen/transferred to another party, the Paylater BCA User must immediately report the same to the nearest BCA branch office or Halo BCA to block/close access to myBCA. All unauthorized transactions made using Paylater BCA before BCA receives such report from the Paylater BCA User shall become the sole responsibility of the Paylater BCA User.
  19. In the event the access to myBCA is blocked/closed, Paylater BCA can no longer be used to make a Transaction.
  20. BCA will impose a late charge on the Paylater BCA User for any amount remaining unpaid after the due date, calculated from the Transaction posting date. BCA has the right to determine the amount of the late charge, which will be notified by BCA to the Paylater BCA User in any form and through any means in accordance with the applicable law.
  21. BCA is not responsible for any defect and deficiency of any nature in the goods or services paid for using Paylater BCA. In the event of any dispute over the Transaction relating to the goods or services, the Paylater BCA User remains obligated to pay the billing amount as specified in the Billing Statement.
  22. The Paylater BCA User shall be fully responsible for any use or misuse of Paylater BCA, whether by the Paylater BCA User or by any other party and must not use Paylater BCA to make transactions that are against the applicable law. All amounts due including any fees and charges incurred in connection with the use of Paylater BCA by the Paylater BCA User shall be the full responsibility of the Paylater BCA User, and therefore BCA has the right to directly claim the same from the Paylater BCA User.
  23. BCA has the right to determine the credit limit for Paylater BCA, which will be notified to the Paylater BCA User in any form and through any means in accordance with the applicable law. The credit limit may be reduced or unconditionally canceled at any time by BCA. The credit limit may also be automatically canceled if the Paylater BCA User’s collectability deteriorates to substandard (kurang lancar), doubtful (diragukan), or loss (macet).
  24. The Paylater BCA User hereby acknowledges that all records, printouts, recordings, communication media, or other evidence in any form held by BCA connected with the Transaction made by the Paylater BCA User constitute valid and conclusive evidence binding on the Paylater BCA User, unless proven otherwise.

C. BLOCKAGE OR TERMINATION OF PAYLATER BCA

  1. BCA, under certain considerations, has the right to block Paylater BCA, terminate the provision of Paylater BCA, and revoke all rights attached to Paylater BCA, including if:terminate the provision of Paylater BCA, and revoke all rights attached to Paylater BCA, including if:
    1. The Paylater BCA User passes away;
    2. There is instruction/request from competent authority to block or terminate the provision of Paylater BCA;
    3. The Paylater BCA User violates the Terms and Conditions for Paylater BCA either in part or in whole, and fails to pay the billing amount arising from the use of Paylater BCA according to the terms and conditions for Paylater BCA;
    4. The Paylater BCA User uses Paylater BCA to make any transaction that violates the applicable law;
    5. The Paylater BCA User uses Paylater BCA for any purposes other than as a payment instrument, or;
    6. There is an indication that the Paylater BCA User uses Paylater BCA to make a cash withdrawal at the Merchant.
  2. BCA has the right to notify the Merchant of the above matters if deemed necessary.
  3. The termination of myBCA does not necessarily result in the termination of Paylater BCA. To terminate the use of Paylater BCA, the Paylater BCA User must apply for the termination of Paylater BCA through the facilities provided by BCA. If Paylater BCA is terminated for any reason, BCA has the right to block Paylater BCA, and the Paylater BCA User is obliged to immediately pay all the outstanding amount due arising from the use of Paylater BCA to BCA by the termination date of Paylater BCA at the latest.
  4. In connection with the termination of Paylater BCA, the Paylater BCA User and BCA agree to waive the provisions of Article 1266 of the Indonesian Civil Code to the extent that a court decision is required to terminate an agreement, and therefore the termination of Paylater BCA does not require a court decision.

D. AUTHORITY TO DEBIT ACCOUNT

  1. As long as the Paylater BCA User still has outstanding obligations to BCA in connection with the use of Paylater BCA and/or other obligations, the Paylater BCA User hereby authorizes BCA to block and/or debit any savings account, current account, time deposit account, reward BCA balance, and/or other accounts owned by the Paylater BCA User, and apply the proceeds to discharge all of the Paylater BCA User’s debts and obligations to BCA, including among other things, the principal, interest, penalty, court costs, and other fees and charges. All the consequences arising from the debiting of the Paylater BCA User’s accountsunder such authority shall be the full responsibility of the Paylater BCA User.
  2. If the Paylater BCA User is a BCA Merchant, BCA has the right to suspend any payment, block and/or debit the Merchant's account, or set off any unpaid sum including any interest, penalty, and other charges and fees against the Merchant’s claims to BCA.
  3. The authority or powers granted under these Terms and Conditions for Paylater BCA are irrevocable and will not terminate for any reason, including the causes specified in articles 1813, 1814, and 1816 of the Indonesian Civil Code as long as the Paylater BCA User still has outstanding obligations to BCA arising from the use of Paylater BCA.

E. FORCE MAJEURE

The Paylater BCA User hereby holds BCA harmless against any claim, suit, and/or other legal action in any form arising from a delay and/or failure by BCA to fulfill its obligations in relation to the provision of Paylater BCA if such delay and/or failure is due to events or occurrences beyond the control or capability of BCA, including but not limited to natural disasters, fire, war, riots, sabotage, equipment/system/transmission breakdown, power failures, telecommunication disruption, government policy prohibiting BCA from providing Paylater BCA to the Paylater BCA User.

F. COMPLAINT HANDLING

  1. Any complaint about Paylater BCA may be lodged by the Paylater BCA User through Halo BCA or a BCA branch office. For the purpose of handling such complaint, BCA may require the Paylater BCA User to provide BCA with a copy of the Paylater BCA User's identity card and other supporting documents. BCA will respond to such complaint in accordance with the prevailing law.
  2. If the Paylater BCA User has a complaint regarding any of the Transactions listed in the Billing Statement, the complaint must be lodged by the Paylater BCA User with BCA no later than 30 (thirty) calendar days of the Billing Statement print date. BCA has the right to not deal with any complaint received by BCA after the lapse of such period.

G. DISPUTE RESOLUTION

  1. The Paylater BCA User agrees that any dispute or difference of opinion arising out of and/or relating to the implementation of these Terms and Conditions for Paylater BCA between the Paylater BCA User and BCA will be resolved in an amicable manner.
  2. Any dispute or difference of opinion that cannot be resolved amicably between the Paylater BCA User and BCA will be resolved by means of banking mediation at Bank Indonesia or the Financial Services Authority or by means of mediation through an Alternative Dispute Resolution Institution included in the List of Alternative Dispute Resolution Institutions established by the Financial Services Authority.
  3. Any dispute or difference of opinion that cannot be resolved in an amicable manner and/or by means of mediation as described in item G.2 above shall be resolved through the District Court of Central Jakarta, without prejudice to BCA's right to file any suit or claim through any other District Court within the territory of the Republic of Indonesia.

H. MISCELLANEOUS

  1. The Paylater BCA User hereby authorizes BCA to use the Paylater BCA User’s data on record with BCA for the Paylater BCA application and analysis process.
  2. The Paylater BCA User shall be fully responsible for the correctness and completeness of data and information provided to BCA and shall hold BCA harmless against all claims and/or legal actions in any form brought by any party including the Paylater BCA User, in connection therewith and the completion of this Paylater BCA application.
  3. BCA has the right to offer BCA’s products/services via personal communication channels. If the Paylater BCA User refuses to obtain such offer, the Paylater BCA User can contact Halo BCA.
  4. The Paylater BCA User hereby agrees to comply with and to be bound by the provisions contained in these Terms and Conditions for Paylater BCA, the Terms and Conditions for myBCA of PT Bank Central Asia Tbk, and all the provisions and procedures applicable at BCA governing Paylater BCA.
  5. BCA has the right to modify and/or supplement the provisions contained in these Terms and Conditions for Paylater BCA, including but not limited to the provisions regarding interest, penalties, administration fees, credit limits, as well as procedures for using Paylater BCA, which will be notified by BCA to the Paylater BCA User in any form and through any means according to the applicable law.
  6. These Terms and Conditions for Paylater BCA is made in 2 (two) language versions, the Indonesian version and the English version. In the event of discrepancy between the terms in Indonesian version and the terms in English version, the terms in Indonesian version shall prevail.
